Update for XRP Holders: The CLARITY Act Isn’t Dead, But…

The cryptocurrency industry spent $233 million supporting political candidates and influencing the 2026 midterm elections, but the massive expenditure did not prevent Democrats from sweeping Congress.

The outcome raises fresh questions about the industry’s political strategy and what it may need to sacrifice to secure the regulatory framework it has pursued in Washington.

Crypto media outlet Cointelegraph examined the election results and their potential consequences for the CLARITY Act.

The outlet noted that the legislation still has a chance of passing, but the industry’s path toward regulatory clarity could become more complicated under the new congressional balance.

HUGE: Crypto spent $233M on the midterms and Democrats still swept Congress.

The CLARITY Act isn't dead, but getting it passed now comes with a price, and the industry won't like what's on the bill.

Crypto Industry Led Corporate Political Spending

Cointelegraph shared figures from a Public Citizen analysis of OpenSecrets.org and Federal Election Commission data through October 23, 2026. The data placed cryptocurrency at the top of the three corporate sectors examined, with $233 million in contributions.

Online betting companies followed with $85.2 million, while the Big Tech and artificial intelligence sector contributed $73.1 million. Together, the three sectors accounted for $391.3 million in corporate political contributions.

The accompanying figures also identified the leading super PACs associated with each industry. Fairshake, which represents the crypto sector, received $106.9 million. Win for America, associated with online betting, collected $80.7 million, while Leading the Future, which represents the Big Tech and AI sector, received $50.1 million.

These three political action committees recorded a combined $237.7 million in contributions. Despite crypto’s position as the largest contributor among the sectors examined, Democrats secured a sweeping congressional victory.

CLARITY Act Could Require Industry Concessions

Cointelegraph connected the election outcome to the future of the CLARITY Act, one of the cryptocurrency industry’s major legislative priorities.

The legislation seeks to establish clearer rules for the digital asset market in the United States. However, the change in congressional control could complicate negotiations and force crypto companies to reconsider some of their demands.

Cointelegraph stressed that the election results do not mean the CLARITY Act has lost its chance of becoming law. Instead, the industry may have to accept compromises to secure enough political support for its passage.

This could require crypto companies to reconsider provisions they previously wanted in the legislation. Cointelegraph’s central point was that regulatory clarity remains achievable, but the industry may not get everything it wants from the final agreement.

Crypto Community Questions Political Strategy

Members of the crypto community also responded to the figures and their potential consequences.

CoinTalk Daily questioned the effectiveness of the industry’s political spending, arguing that spending $233 million without preventing Democrats from taking control of Congress represents an expensive lesson in political lobbying.

5210YLASSETS offered another explanation, pointing to the economic concerns that influence ordinary voters. The commenter argued that cryptocurrency does not directly address everyday pressures such as rising food and fuel prices. The industry, therefore, should not assume that its priorities carry the same weight for the wider population.

The_Web3guy focused on the regulatory challenge ahead. The commenter explained that political influence does not guarantee favourable legislation and stressed that the industry must pursue clear rules without compromising the innovation it wants to protect.

The election results leave crypto companies with an important legislative challenge. They must now work with a different congressional environment and determine which concessions they can accept to advance the CLARITY Act.
